1- Our \u05de\u05e9\u05e0\u05d4 and \u05d1\u05e8\u05d9\u05d9\u05ea\u05d0 continue on the topic of the announcement and implementation concerning the laws of \u05db\u05dc\u05d0\u05d9\u05dd.<\/p>\n

\"Frugally<\/p>\n

On the 15th of Adar the \u05e9\u05dc\u05d5\u05d7\u05d9 \u05d1\u05d9\u05ea \u05d3\u05d9\u05df would go out to the fields and plantation and if they would encounter \u05db\u05dc\u05d0\u05d9\u05dd, they had the authority to uproot the plants. At a later time in history,\u00a0 \u05d1\u05d9\u05ea \u05d3\u05d9\u05df would declare the entire field of the scofflaws as \u05d4\u05e4\u05e7\u05e8. (or \u05d4\u05d1\u05e7\u05e8 as some version of the \u05d9\u05e8\u05d5\u05e9\u05dc\u05de\u05d9 have it).<\/p>\n

\"Israeli<\/p>\n

2- The \u05d2\u05de\u05e8\u05d0 discusses the source of this power that \u05d1\u05d9\u05ea \u05d3\u05d9\u05df has, to declare private property as \u05d4\u05e4\u05e7\u05e8. Forfeiture by the courts.<\/p>\n

\"\u05d4\u05e4\u05e7\u05e8<\/p>\n

3- We discussed the history of the beginning of \u05d1\u05d9\u05ea \u05e9\u05e0\u05d9 and the dilemma of Ezra, realizing that from the rather small amount of people that came to \u05d0\u05e8\u05e5 \u05d9\u05e9\u05e8\u05d0\u05dc from \u05d1\u05d1\u05dc, some were married to non-Jewish wives. This problem was even with the \u2018bessere mentchen<\/em>\u2019…..<\/p>\n

Ezra 9-10 <\/em><\/p>\n

Now when these things were done, the princes drew near unto me, saying: ‘The people of Israel, and the priests and the Levites, have not separated themselves from the peoples of the lands, doing according to their abominations, even of the Canaanites, the Hittites, the Perizzites, the Jebusites, the Ammonites, the Moabites, the Egyptians, and the Amorites.<\/em><\/p>\n

\u00a0<\/em>For they have taken their [non Jewish] daughters for themselves and for their sons; so that the holy seed have mingled themselves with the peoples of the lands; and the hand of the princes and rulers had been first in this faithlessness.’ <\/em><\/p>\n

\u00a0<\/em>4- So a very distraught Ezra decides to call all of\u00a0 \u05db\u05dc\u05dc \u05d9\u05e9\u05e8\u05d0\u05dc to a meeting in \u05d9\u05e8\u05d5\u05e9\u05dc\u05d9\u05dd. The purpose was to admonish all those with non Jewish spouse to part from them.<\/p>\n

\"Ultra-Orthodox<\/p>\n

And they made proclamation throughout Judah and Jerusalem unto all the children [that returned from ] the captivity, that they should gather themselves together unto Jerusalem;<\/em><\/p>\n

\u00a0<\/em>And that whosoever came not within three days, according to the counsel of the princes and the elders, all his substance should be forfeited, and himself separated from the congregation of the captivity.<\/em><\/p>\n

From the above threat of forfeiture, the \u05d2\u05de\u05e8\u05d0 derives that \u05d1\u05d9\u05ea \u05d3\u05d9\u05df, when necessary, has a right and authority to be \u05de\u05e4\u05e7\u05d9\u05e8 an individual\u2019s property.<\/p>\n

\"Civil<\/p>\n

5- The \u05d2\u05de\u05e8\u05d0 then continues to question if this power of forfeiture has the ability to effect even at a \u05d3\u05d0\u05d5\u05e8\u05d9\u05d9\u05ea\u05d0 level.<\/p>\n

6- We ended with an interesting observation.<\/p>\n

The \u05d2\u05de\u05e8\u05d0 says that\u00a0 \u05d1\u05d9\u05ea \u05d3\u05d9\u05df followed certain guidelines when deciding if a particular year should be declared a \u05e9\u05e0\u05d4 \u05de\u05e2\u05d5\u05d1\u05e8\u05ea and thus will be a 13-month year.<\/p>\n

The primary reason for adding a 13th month was to ensure that \u05e4\u05e1\u05d7 occurs in the spring time.<\/p>\n

\"Springtime<\/p>\n

However, there were exceptions to this rule.<\/p>\n

For example if the year in question, to turn it into a 13 month year or not, was the year of \u05e9\u05de\u05d9\u05d8\u05d4, or the year after \u05e9\u05de\u05d9\u05d8\u05d4, they would not proclaim it a \u05e9\u05e0\u05d4 \u05de\u05e2\u05d5\u05d1\u05e8\u05ea even if that caused \u05e4\u05e1\u05d7 to arrive early.<\/p>\n

The reason is that the \u05e9\u05de\u05d9\u05d8\u05d4 prohibition would make food scarce due to the lack of plowing and planting in year 7.<\/p>\n

\"Emptying<\/p>\n

Therefore, stretching years 7 or 8 for an extra month would cause hardship.<\/p>\n

7- The \u05d2\u05de\u05e8\u05d0 then adds another point. All the above guidelines, were only\u00a0 when \u05e9\u05e0\u05d9\u05dd \u05db\u05ea\u05e7\u05e0\u05df, not when \u05d0\u05d9\u05df \u05d4\u05e9\u05e0\u05d9\u05dd \u05db\u05ea\u05e7\u05e0\u05df.<\/p>\n

When \u05d0\u05d9\u05df \u05d4\u05e9\u05e0\u05d9\u05dd \u05db\u05ea\u05e7\u05e0\u05df, the above rule, of not turning years 7 or 8 into leap years, do not apply.<\/p>\n

What do these words mean? \u2018Years that are proper\u2019, or years that are \u2018they way they are supposed to be\u2019?<\/p>\n

Some commentaries say that at a certain time in history the time\/season\u00a0 of the wheat harvest was delayed. Meaning that the \u05ea\u05d1\u05d5\u05d0\u05d4, unlike previous years, would not be ready to be harvested until after \u05e4\u05e1\u05d7.<\/p>\n

We wondered out loud if this is similar to other facts or laws of nature that have gradually changed since \u05d1\u05e8\u05d9\u05d0\u05ea \u05d4\u05e2\u05d5\u05dc\u05dd\u00a0 and consequently (perhaps) have an effect on \u05d4\u05dc\u05db\u05d4.<\/p>\n

Yet someone remembered that in Israel, the wine grapes were harvested primarily in September…?<\/p>\n
