Short notes on topics discussed.<\/p>\n

1- Spent time discussing \u05e8\u05d5\u05d1 and \u05e7\u05d1\u05d5\u05e2.<\/p>\n

The classic example, as mentioned in our \u05d2\u05de\u05e8\u05d0, is a piece of meat found on the street in a neighborhood like Crown Heights, where most stores selling meat are Kosher.\u00a0 The \u05e8\u05d5\u05d1 sells Kosher.
\nThe single Bodega on Troy Ave. is the \u05de\u05d9\u05e2\u05d5\u05d8.<\/p>\n

\"Tray<\/p>\n

[This is not exactly<\/em> the case of \u05ea\u05e9\u05e2 \u05d7\u05e0\u05d5\u05d9\u05d5\u05ea- just a example]<\/p>\n

Think of a wrapped burger sandwich found on Kingston Avenue that perhaps fell off an Uber Eats moped.<\/p>\n

\"Wrapped<\/p>\n

Obviously, the meat found is not tray packed with a Hechsher\u2026.<\/p>\n

So what are the odds the burger was cooked and prepared in one of the many Kosher stores and take-out locations? 9:1.<\/p>\n

We therefore deem the sandwich to be Kosher (leMahadrin) since the majority of stores in the neighborhood sell Kosher.<\/p>\n

\"\"<\/p>\n

This is the simple definition of \u05e8\u05d5\u05d1.<\/p>\n

Now for \u05e7\u05d1\u05d5\u05e2.<\/p>\n

However, if one goes shopping, buys meat and when he comes home he cannot remember if the meat he purchased was from a Kosher or the non-Kosher store. (Say he occasionally buys cheaper non-Kosher meat for his non Jewish workers).<\/p>\n

Since this \u2018doubt\u2019 \u05e1\u05e4\u05e7, began inside whatever store he purchased the meat, it is designated as \u05e7\u05d1\u05d5\u05e2, meaning that we do not follow \u05e8\u05d5\u05d1.<\/p>\n

\"\"<\/p>\n

We deem it \u05e7\u05d1\u05d5\u05e2 and it\u2019s only a 50-50 chance that it\u2019s Kosher and therefore forbidden to eat.<\/p>\n

The logic behind this? After all, most of the stores sell only Kosher. So why do we not follow the \u05e8\u05d5\u05d1?<\/p>\n

The answer, as most \u05e8\u05d0\u05e9\u05d5\u05e0\u05d9\u05dd write, [Tosfos, Sanh. 79a –<\/a>\u05d5\u05db\u05dc \u05e7\u05d1\u05d5\u05e2<\/a> ] <\/span>is that it is a \u05d2\u05d6\u05d9\u05e8\u05ea \u05d4\u05db\u05ea\u05d5\u05d1 or a \u05d7\u05d9\u05d3\u05d5\u05e9! [Some \u05d0\u05d7\u05e8\u05d5\u05e0\u05d9\u05dd do give some logic to this. See – \u05e7\u05d5\u05d1\u05e5 \u05e9\u05d9\u05e2\u05d5\u05e8\u05d9\u05dd \u05db\u05ea\u05d5\u05d1\u05d5\u05ea \u05d0\u05d5\u05ea \u05de<\/em>].<\/p>\n

2 – We added another interesting point to the \u05e7\u05d1\u05d5\u05e2.
\nIn the example above, when finding a burger on Kingston Ave, we follow the \u05e8\u05d5\u05d1, which are the nine stores selling Kosher versus one \u05d8\u05e8\u05d9\u05e4\u05d4 Bodega.<\/p>\n

\"\"<\/p>\n

But what if, for example, the \u05d8\u05e8\u05d9\u05e4\u05d4 store is a Costco. On any given day, Costco sells more meat than the total<\/strong> sales of all 9 Kosher stores!<\/p>\n

\"\"<\/p>\n

Discussed the opinion of the \u05d7\u05d5\u05d5\u05ea \u05d3\u05e2\u05ea (YD 110, 3) see here top of page 3<\/a> and others that we do not take that into consideration. In other words – we follow the majority of sellers<\/strong> and not the majority of meat sold.<\/p>\n

But why? By far most of the burgers in the neighborhood are from Costco? What is their reasoning?<\/p>\n

Interestingly,\u00a0 proof on how to rule on the above a case\u00a0 is based on our Mishna when finding coins near the 13 Pushkes, with\u00a0 6 for \u05e0\u05d3\u05d1\u05d4 versus one for \u05e9\u05e7\u05dc\u05d9\u05dd.<\/p>\n

3- We mentioned the \u05e0\u05d5\u05d3\u05e2 \u05d1\u05d9\u05d4\u05d5\u05d3\u05d4 that agrees to the above.<\/a><\/p>\n

The case he discusses is in regard to purchasing oven-dried fruits for \u05e4\u05e1\u05d7 from a non Jew. The issue was\/is if the fruits were\/are baked in a bread oven.\u00a0 Additionally, flour is generally sprinkled on the bottom of the oven for the fruits not to stick.<\/p>\n

He is \u05de\u05ea\u05d9\u05e8 to buy from a wholesaler [that buys these dried fruits from many vendors] if the majority of the producers use special ovens [non \u05d7\u05de\u05e5] to dry their fruits, \u05db\u05dc \u05d3\u05e4\u05e8\u05d9\u05e9.\u00a0 This is even if there is a large producer that does not<\/em> <\/strong>use a special oven and out-produces all others.<\/p>\n
